MEGA Brands Magnetix Class Action Settlement

By , About.com GuideOctober 3, 2011

Follow me on:

A class action suit was brought against MEGA Brands claiming that 10 million magnet toys (Magnetix, Mag-Warriors, Magnaworld, Magna-Bugs, Magna-Wheels, Magna-Saurs, Magna-Bones, among others) included defective magnets.  No personal injury claims were made. MEGA Brands agreed to a settlement.  A "Class Member" is a consumer who bought or received a qualifying Magnet Toy. The amount of payment to the Class Member is dependent upon whether the person returned a toy that was subject to a CPSC recall, still has a receipt or other proof of purchases, possesses physical evidence such as a piece of the toy, toy packaging, or a manual. Otherwise the class member can submit a statement under oath that they either purchased or received one of these toys. A Class Member could receive payments of up to a full refend if they provide proof of purchase. Those without proof of purchase will receive an amount akin to the suggested list price of the toy, or other form of payment called for in the settlement agreement. Class members must submit a form to receive cash benefits. A complete list of the toys involved is listed on the website www.megabrandssettlement.com or by calling 1-800-760-6332.
